Mortgage During Divorce

You Have Options

Making decisions about a mortgage in a divorce is typically more complex than people realize. Many find themselves changing direction late in the divorce process, which can waste thousands of dollars in attorney fees. If you begin with a clear understanding of your options regarding your house, you’ll greatly increase your chances of a more successful, lower-cost divorce. Some of the things we can help with are:

  • Understanding if child support or spousal maintenance can be used as qualifying income, and the required time frames for the receipt of these funds.
  • Understanding your options for removing a name from the current loan.
  • Understanding the time frames for purchasing (exiting spouse) and refinancing (retaining spouse), and whether the divorce needs to be final to conduct these transactions.
  • Making sure the necessary language for your home and/or mortgage scenario is in the divorce decree.
  • Understanding when an exiting spouse can purchase a new home before their name is removed from the current loan.
  • Understanding how the retaining spouse can save on their interest rate when refinancing to take cash out to pay a marital settlement.

Your Divorce Mortgage Expert

As a loan officer since 2002 (in both small and large companies), I have built a reputation for providing outstanding service to my clients. Home financing shouldn’t be confusing and stressful, so I pride myself on being the originator who cares enough about you to:

  • Provide education about your options so you can make the best financial decisions for your family.
  • Communicate during the process so you can see your loan’s progress and know what we need from you.
  • Identify potential obstacles/issues early in the process and address them immediately to avoid surprises or delays.
  • Push your loan through processing and underwriting as if it were my own.
  • Take calls and provide pre-approval letters on evenings and weekends.

I am a licensed, educated, experienced mortgage professional with extensive background in conventional, FHA, VA, jumbo, USDA, and investment property home loans for purchases and refinances.

I also specialize in mortgage issues arising in divorce, such as little-known ways the retaining spouse can remove the exiting spouse’s name from the loan, when the exiting spouse can buy again, when child support/spousal maintenance income can be used to qualify for a new loan (and when it cannot), and more. Most loan officers do not encounter the underwriting differences in these transactions often enough to be familiar with them. If you know someone going through a divorce, it is critical they speak to someone who specializes in this field before the decree is final!

Integrity and ethics are the backbone of my business and my reputation. I will always give my clients the same advice I would use myself, without any ulterior motives. I have had many past clients seek me out years later because they know I have their best interests in mind. Our relationship doesn't end at the closing. My goal is to provide you with a superior experience and become your mortgage consultant for life!

Brett Leschinsky with CrossCountry Mortgage did a fantastic job helping us with a refinance of our primary Minnesota home. We started the process of refinancing by looking at online do it your self options, but are so happy we called Brett. Brett was there every step of the way and always available to answer our questions. Brett is a true mortgage professional and we would highly recommend him to anyone looking at securing a mortgage or refinance.

Karl G.

Brett not only knows what he is doing but also makes sure you know what exactly is going on through the loan process. Brett is so easy to work with. You can literally call him at any time and he will answer or get back to you the same day. I would recommend him to anyone who is looking for someone that puts the customer first and makes the loan process easy! He will be my first call when I decide to refinance or buy again! I can’t say enough good things about him!
